According to occupational health and safety legislation and good practice, employers must subject employees to medical surveillance where any potential health hazard is identified. Examples of high-risk exposures are working at heights, working in confined space, working in extreme temperatures, lifting heavy loads, drivers and/or operators of machinery as well as exposure to hazardous chemical substances, hazardous biological agents and high levels of noise.

The Occupational Health and Safety Act, No 85 of 1993, and regulations, (OHSA) as well as the Mine Health and Safety Act, No 29 of 1996, and regulations (MHSA) regulates health and safety in the workplace. It is the responsibility of an employer to implement a health and safety policy and ensure all requirements of relevant legislation and regulations are met. Employers are expected to conduct hazard identification and risk assessments (HIRA) in order to identify potential hazards and to quantify the risks related to the workplace which must include the identification of health hazards.

The Compensation for Occupational Injuries and Diseases Act No 130 of 1993 (COIDA) expects employers to register their companies, declare how many employees are employed by the company and the annual earnings of these employees. Annual premiums are payable to ensure the employer status remains in good standing. Previously called Workman’s Compensation or WCA, COIDA cover is a type of insurance that the employer must pay on behalf of the employee. COIDA prescribes how employers are supposed to report and manage occupational injuries and diseases and which benefits can be claimed from the Compensation Fund. COIDA compliance is an important part of health and safety compliance.

In order for MSPs to submit invoices for the treatment of occupational injuries and diseases to the relative insurer (CF, RMA or FEM) and receive prompt payments, it is important to understand the COIDA provisions and the different processes at each insurer. It is often non-compliance by the employer or the employee that results in delayed payment or rejection of medical invoices.
